1. Who we are and what these Terms cover

These Terms of Service ("Terms") are a binding agreement between you ("you", "User") and FxHomeLab ("FxHomeLab", "we", "us", "our"), operator of the website fxhomelab.com and its related applications, subdomains, and services (together, the "Platform").

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Risk Disclosure Statement, Refund & Cancellation Policy, Cookie Policy, and Disclaimers & No-Affiliation Notice, which are incorporated into these Terms by reference. If you do not agree, do not use the Platform.

2. What FxHomeLab is — and what it is not

FxHomeLab is an educational and skills-assessment platform for people learning to trade the foreign exchange (forex) and related markets. The Platform provides learning content, comprehension checks, chart-annotation exercises, a simulated trading environment, and a simulated "prop-firm-style" challenge that, on completion, may issue a verifiable badge.

You expressly acknowledge and agree that:

(a) The Platform is for education and practice only. It does not provide financial, investment, trading, tax, or legal advice, and nothing on it is a recommendation to buy, sell, or hold any financial instrument. See the Risk Disclosure Statement.

(b) FxHomeLab is not a broker, dealer, prop trading firm, funded-account provider, investment adviser, portfolio manager, or financial institution. We do not accept deposits for trading, do not execute real trades on your behalf, and do not hold, manage, or trade your money in any market.

(c) All trading on the Platform is simulated. Positions, balances, profit, and loss are generated in a practice environment using historical and/or delayed market data. Simulated results use no real money and do not represent real trading outcomes.

(d) The badge or credential you may earn is proof of skill in our simulated environment only. It is not a funded trading account, an offer of capital, a licence, a professional qualification, or a guarantee of any outcome in real markets or with any third party. See the Disclaimers & No-Affiliation Notice.

(e) We are not affiliated with, endorsed by, or sponsored by any real proprietary trading firm (including but not limited to FTMO, FundedNext, FundingPips, or GoatFunded) or any broker. Where we reference their rule structures, it is for education and interoperability of practice only, and all such names and marks belong to their respective owners.

3. Eligibility

To use the Platform you must:

be at least 18 years old (or the age of majority in your jurisdiction, if higher);
have the legal capacity to enter into a binding contract;
not be barred from using the Platform under the laws of Nigeria or of your country of residence; and
not be located in, or a resident of, any country subject to comprehensive sanctions, or be a person with whom we are legally prohibited from dealing.

The Platform is not intended for persons under 18. If we learn that we have collected information from a person under 18, we will delete it. See the Privacy Policy.

You are responsible for ensuring that your use of the Platform is lawful in your own country. Some jurisdictions restrict access to trading-related or crypto-related services; you use the Platform at your own risk and remain solely responsible for your local legal compliance.

4. Accounts and security

You must provide accurate registration information and keep it up to date. You are responsible for all activity under your account and for keeping your credentials confidential. Notify us immediately at [CONTACT EMAIL] of any unauthorised use. We may suspend or terminate accounts that we reasonably believe are compromised, fraudulent, shared in breach of these Terms, or used to abuse the Platform.

One person may hold one account. Creating multiple accounts to obtain additional free access, manipulate leaderboards, or evade a suspension is prohibited.

5. Subscriptions, plans, and payment

5.1 Plans

The Platform offers a free tier and one or more paid subscription tiers ("Pro", "Plus", or as renamed from time to time). The features included in each tier, and their prices, are as shown on the Platform at the time of purchase.

5.2 Prepaid, forward-dated model

Paid tiers are sold as prepaid passes (e.g. monthly, quarterly, or annual) that extend your access period. Payment grants you access to the applicable tier for the stated period. Where a recurring card mandate is supported and enabled, your plan may auto-renew; where it is not, access simply lapses at the end of the paid period unless you buy another pass.

5.3 Payment providers

Payments are processed by third-party providers, which may include Paystack (cards, bank transfer, USSD) and a cryptocurrency payment processor for digital-asset payments. Your use of a payment provider is subject to that provider's own terms. We do not store full card numbers. Crypto payments are recognised and regulated in Nigeria as digital/virtual assets under the applicable securities framework; you are responsible for any tax consequences of paying in crypto.

5.4 Pricing changes

We may change prices. Price changes do not affect the pass you have already paid for. Where we have expressly offered "founder" or grandfathered pricing, we will honour it on the terms stated at the time of your subscription.

5.5 Refunds

Refunds and cancellations are governed by our Refund & Cancellation Policy.

6. Acceptable use

You agree not to:

use the Platform for any unlawful purpose, or in breach of any applicable law or regulation;
represent, imply, or market that a FxHomeLab badge is a funded account, a real trading credential, a licence, or an offer of capital;
reverse-engineer, scrape, copy, resell, sublicense, or create derivative works from the Platform, its content, or its data, except as expressly permitted;
attempt to bypass, exploit, or manipulate the scoring, challenge, leaderboard, cool-down, or billing systems (including automated play, exploiting look-ahead, or falsifying results);
upload malicious code, attempt to gain unauthorised access, or interfere with the Platform's operation, security, or availability;
infringe the intellectual-property or privacy rights of FxHomeLab or any third party;
harass, abuse, or harm other users, or post unlawful, defamatory, or misleading content in any community or social feature.

We may investigate and take action — including content removal, feature restriction, suspension, termination, invalidation of a badge, and referral to authorities — for any breach.

7. Intellectual property

All content, software, code, curriculum, text, graphics, designs, logos, the "FxHomeLab" name and brand, and the arrangement of the Platform are owned by FxHomeLab or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own non-commercial learning and practice, subject to these Terms. No other rights are granted.

Any feedback or suggestions you give us may be used by us without restriction or obligation to you.

8. Third-party services and data

The Platform relies on third parties, including market-data sources (e.g. Deriv), payment processors, hosting, and analytics. We are not responsible for the acts, omissions, availability, accuracy, or terms of any third party. Market data may be delayed, incomplete, or inaccurate and is provided for practice and education only, without warranty.

9. Simulated nature, no warranty of results

You acknowledge that skill, scores, badges, or results achieved in the simulated environment do not predict, guarantee, or represent results in real markets. Trading real money involves substantial risk of loss. See the Risk Disclosure Statement. We make no representation or warranty that using the Platform will make you profitable, employable, or eligible for any funded programme.

10. Disclaimers

To the maximum extent permitted by law, the Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the Platform, market data, or scoring will be accurate, complete, current, or free of defects.

11. Limitation of liability

To the maximum extent permitted by applicable law:

(a) FxHomeLab, its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading losses (real or simulated), arising out of or relating to your use of, or inability to use, the Platform — even if advised of the possibility.

(b) Our total aggregate liability for all claims relating to the Platform will not exceed the greater of (i) the total amount you paid to FxHomeLab in the six (6) months before the event giving rise to the claim, or (ii) ₦20,000 (approximately USD 50).

(c) Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including under the Federal Competition and Consumer Protection Act and mandatory consumer-protection rights).

Because you never trade real money on the Platform, you cannot suffer, and we are not liable for, real market trading losses arising from the simulation. Any decision you make to trade real money elsewhere is entirely your own.

12. Indemnity

You agree to indemnify and hold harmless FxHomeLab and its owners, officers, employees, and contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, your violation of any law, or your infringement of any third-party right — including any claim arising from your real-market trading decisions or your misrepresentation of a badge.

13. Suspension and termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Platform or other users. On termination, the licence in Section 7 ends and Sections that by their nature should survive (including 2, 7, 9–14) survive.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rights available to you in your country of residence, the courts of Lagos, Nigeria have jurisdiction, and you and we submit to that jurisdiction.

Before commencing formal proceedings, you agree to first contact us at [CONTACT EMAIL] and attempt to resolve the dispute in good faith for 30 days. (Optional — confirm with counsel: the parties may agree to resolve disputes by arbitration under the Arbitration and Mediation Act 2023, seated in Lagos, Nigeria.)

15. Changes to these Terms

We may update these Terms. If we make material changes, we will notify you (e.g. by email or an in-Platform notice) and update the "Last updated" date. Continued use after changes take effect means you accept the revised Terms. If you do not agree, stop using the Platform.

16. General

These Terms, plus the documents incorporated by reference, are the entire agreement between you and us regarding the Platform. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor or affiliate. Notices to you may be sent to your registered email.
